i own my own home and have miscellaneous income. I don't want to have to file jointly, as my husand owes child support

Your may be better off filing married filing joint and attaching form 8379 Injured spouse allocation. The reason you would state on the form would be that your spouse owes back child support that you are not liable for. The form goes through the different lines on the 1040 and allocates the income deductions and the refund. The portion of the refund that is yours would then be sent to you (if you get it in check form the check will only have your name) and the portion that is your husband's would be applied to the child support.

If you are married then you have 2 choices. Married filing joint or married filing separately. Those are your options. It doesn't matter how long you were married in 2006. You could have only been married on second, and still those would be your only options.

Your filing protects you from your his x-family to tag child support on your tax and on his income only. If you 2 share common bank accounts and he borrows money from that account, you are still liable for debts against these accounts

Don't broadcast it but file married only if you were married earlier than november otherwise file single seperately
