After a job change 9 months ago,and they have admitted they should have done this then but continued to pay me on the higherr rate

Absolutely. What they have to do is give you a new contract to sign specifying the details of your new position, including your new rate of pay. If you don't want to sign, you can be terminated.

However, I think you have some room for negotiation here. It depends on what work you do - obviously in some industries, rates of pay are set by unions or whatever and they are absolutely non-flexible. But, if this does not apply to you, then you should argue to your employer that you will quit if you are forced to take a lower salary, and the cost to them of recruiting and retraining a replacement will be much higher than if they just continue to pay you at the higher rate.

Depends on the terms of your employment contract. If the new job's pay rate is lower then yes they can, however they should not be able to lower your rate at this point without a performance review since you have been paid at the higher rate. Another however, though, is its there business and they can do what they want as long as they aren't violating their own policies or the terms of your employment contract.

If you agreed to the new rate of pay when you were given the job, then yes. The higher rate has been paid in error and the employer has the right to correct the error - and recover the overpayment.

It should be in your contract your rates of pay

I think they can do it, at least they are not asking for the money to be paid back

Well, If you are working less hours and have been demoted to toilet cleaner...I guess they can.
