I bought a DVD off eBay but when it arrived it was badly damaged and does not play properly on any of my DVD players. I have e-mailed the seller but there is no reply. He has not left me feedback yet so what should I do? - I don't want to get negative feedback because that’s what he will give me if I give him it.
Thanks

if is damaged and he didnt say it was, and providing its not ur fault, any bad feedback he leaves u can be taken off by ebay admins if you prove it was put there wrongfully, and also you can get your money back for it by opening a dispute in paypal (that is if he didnt say it was damaged or u didnt drop it when it arrived)

You're lucky it was just a DVD. This happened to me a few years ago. I bought a software and I never got it. If you pay it through Paypal, you can file a dipute resolution with them. They will try to recover the funds within 30 days. If they can't resolve the issue then you've just lost that money unfortunately. That's the same thing that happened to me, I payed the guy $300 for the software, and Paypal wasn't able to recover the funds. So then I had to report him to eBay and then he gets a warning the first time. The second time someone else reports him, his account gets cancelled and cannot renew or make a new account. That may not be much, but at least we get that person off eBay and prevent it from him doing it to somebody else. Always look at sellers feedback. And if they have negative feed back try to look for them and read why people left him negative feedback. Good luck!

Give him neutral feedback and put a comment about the condition it was in when it arrived without pointing the blame directly at the seller. This should make other ebay buyers aware and they will think twice about buying from this person. He will be the eventual loser.

You must file a claim with eBay. If you've paid thru PayPal, eBay will inform you to claim thru PayPal. Do not leave a neutral feedback at this stage. If and when PayPal reimburse you, you can then decide which feedback to use, depending on how the seller has dealt with your claim.

Try messaging them through eBay it'self rather than email .Many sellers ( like me ) don't check emails that often . I actually put in my auctions to mail me that way or you might not get a reply soon . Most sellers prefer you to come to them with problems rather than negative feedback . He might get back to you sooner :)
If he states that it wasn't damaged on posting ask him to send you the receipt so you can claim through the post office ..

Let me know how it goes ! Oh and it wasn't me ! :)P

grayness,

"any bad feedback he leaves u can be taken off by ebay admins if you prove it was put there wrongfully,"

no they will not remove it unless the neg violates the feedback policy.

if you paid for the DVD through PAYPAL and used a CREDIT CARD, then no matter what happens with your dispute, you can file for a chargeback with your CC company.

ALWAYS use that CREDIT CARD!

and remember, anyone that looks at the neg feedback will realize it is a retalitory feedback. it will not hurt you as a buyer.

If you got into your My Ebay page - on the menu on the left hand side is a tab for Dispute Console. If you click this there is an option to report an item as faulty/not as described. After 10 days, you will be able to make a claim. I hope this helps.

hmm the only suggestion is to report to ebay if you can and do leave him NEGATIVE feedback in big capital letters so other buyers will be put off as it may be a copy he will soon get back to you as they dont like negative feedback, if he does leave someting bad try and report him, GOOD LUCK LOVE!!
