If an individual is legally separated in New York State, and obtains co-ownership in a limited liability corporation during the separation and before the divorce, can the astranged spouse effectivle attach claim to a portion of the Ltd? Would this depend on the separation agreement?

As a general rule a separated spouse does not have an interest in assets of the marital partner acquired after a legal separation. However, this being NY State, you can probably find a lawyer who can make a claim for anything.

No. she cannot go after the company at all. The best she can hope for is child support or alimony (depending on what the court gives her) based on the capital gains earned through the company. A LLC is owned by the partners, but not OWNED. A LLC is a seperate entity by law.
