My fiance has a drug problem and I want him out of my house but he's on the lease. How do I get him off? Our lease is up in March but I need to get him out NOW! Is there anything I can do?

You can not modify your lease until it is up or if you break the contract and then to get him out YOU are going to have to evict him. Have the police come and search your house and take him to jail.

Talking to your apartment manager is probably not going to help you much. If your boyfriend is on the lease, he is a party to that agreement and you would all have to agree to ammend the lease. He is due the same securities of the lease that you and the apartment manager is. Unless, you have something in your agreement about breaking the law negates the contract. Look into that.

Otherwise, you evicting him is the option you should really pursue.

If law enforcement got a tip and found drugs in your home, do you realize that you will be carted off to jail? How will that affect your employment? How do you feel about being considered an accessory? Will you keep him as your fiance or break it off? Are you afraid of him? Will there be repercussions if he finds out that you called the law? Are children involved? Anything stopping you from moving yourself out temporarily?

By the time you try to have him removed from the lease your expiration will be up. The landlord needs to know if you plan to stay because the lease agreement may have been made with the expectation of both employed persons handling the monthly cost. So rather than put all your energy into moving him out, consider also how fast you can remove yourself. The landlord expects to be paid and by now you've likely paid your Feb rent.

Not really.If he's on the lease and in most states even if he's not on the lease.If you let someone stay more than one night they are considered a resident of the PREMISES and you have to go to the local court house and file for a writ of eviction.Can be a pretty long and dragged out process.You might try a resraining order since you could say he has a DRUG PROBLEM AND YOUR AFRAID OF HIM.bY THE TIME THAT DRAGS OUT IN COURT YOU COULD RENEW YOUR LEASE AND LEAVE HIM OFF IT.

Call the police the next time he is using or has drugs on him. They will haul him off and you can live there for the rest of the lease. It does not matter if he is on the lease or not.

If you are that desperate to be away from him, speak to Apartment Manager. Explain the situation and if you like where you live and do not want to leave the complex, see if they will move you to another apartment. Offer to pay the remainder of the rent for him to live there and to satisfy your lease agreement and then just ask to have a new apartment. Most apartment managers do not want that sort of 'riff raff' there so they might accommodate you.

well, that is up to your lease owner... If you explain the situation, being so close to the renew date that he/she could help you. They could allocate the already paid funds (if need be)...
