I WAS TURNING RIGHT AT A JUNCTION,AS I APPROACHED I CHECKED THE JUNCTION AS I HAD TO GIVE WAY TO ANY TRAFFIC ALREADY ON THE ROAD.AS I APPROACHED THE GIVE WAY DOTTED LINE I MADE FINAL SAFETY CHECKS AND ATTEMPTED TO MANEUVER THE RIGHT TURN.AS I REACHED THE MIDDLE OF THE ROAD WITH THE MAJORITY OF THE CAR CLEAR . I NOTICED ANOTHER DRIVER SPEEDING TOWARDS ME THEY HIT MY REAR QUARTER OF THE CAR (BACK WHEEL & HALF PASSENGER DOOR) THE CAR IS NOW A RITE OFF,I WENT BACK TO THE SCENE AND NOTICED THE JUNCTION IS BLIND FOR ANY APPROACHING VEHICLE TRAVELING AT SPEED.IN MY VIEW THE OTHER DRIVER WAS AT FAULT FOR SPEEDING AND FALLING TO CONTROL THERE VEHICLE.. AND ALL DAMAGE WAS CAUSED BY THEM HITTING ME...ANSWERS PLEASE

AT THE TIME OF THE ACCIDENT NEITHER ME OR THE OTHER DRIVER TOOK LIABILITY.
ALSO THE DRIVER WAS RUNNING LATE FOR WORK AS I HAD DROPPED MY GIRLFRIEND OFF AT THE SAME PLACE WERE THE DRIVER WAS HEADING 20 MINUTES PREVIOUSLY

POLICE WERE CALLED THEY NEVER MEASURED OR CHECKED FOR SKID MARKS OR ANYTHING THEY JUST GOT THE VEHICLES RECOVERED OFF THE ROAD.

You were on the wrong side of the road, therefore you are primarily to blame, if it can be proved that the other driver was driving without due care, maybe the blame will be split 25% to him and 75% to you.
Assuming no injuries were incurred then it will be down to the insurance companies to sort it out, if your car is a "write off" financially you may still be able to repair it, if it is beyond repair hard luck.
You will no doubt lose your NCB, and if you do not have comprehensive cover, the car also

Did either of you call a police officer or trade insurance policy information. When involved in an accident its extremely important to do so. When an officer writes a summons they generally will hand it to one party or the other, Who ever gets the ticket is to blame for the accident. In this case it sounds as if you were struck from behind both your front doors. The person following would have been at fault. You are responsible for everything in front of you as you drive forward. If both your insurance holders have this information it may take awhile to receive damages. On second thought you do have an option. In stead of taking their pay out you have the option of demanding a (like) replacement of your auto. Ins. company's don't like to mess with this but it's their job.

This falls into the category of a rear-ender. They are 100% at fault. When they were approaching your vehicle, they are supposed to reduce speed, and maintain 3 seconds distance. Since they collided with your rear end, they will have to assume all responsibility for this accident. Ask a cop, or a judge, they will tell you the exact same thing. If the other driver wants to fight it, they will lose, and will lose out on a lot of money for the legal fees. People do need to learn to drive a little more cautiously, and watch their speed. If there were police present, they will be able to determine whether or not the other vehicle was speeding, and if they were, they will be in even more trouble, for wreckless endangerment. This is a am awful situation it has hapened to me in the past. I think you will find the insurance companies will treat it as Kock for knock and not lay blame the worst way is they will lay blame to you as the onus is always on the person turning into the road at a junction. Sorry it is not good news but dealing with insurance companies over car claims never is.

Hi, most rear enders are the car behinds fault. It sounds like he couldnt have been paying attention as if its a junction on a blind bend there would be a sign to advise in, for example, 100 yards or 200 yards there is a jctn on a blind bend also there should be SLOW painted on the road before the bend. these 2 warnings are also put when there are 2 hazards in a space of 100 yards. so definatly their fault.

Your at fault for pulling out of a blind junction when it's not safe to do so. Can you prove the other driver was speeding? If not your on to a looser.

Yes if other party was speeding then i would say it ther fault however some people can take an eternity to exit a junction so possible ur fault

Unfortunately it sounds like it was your fault, but unintentional. I wouldn't admit that you are in the wrong though, as you'll end up paying out more. I would highlight to your insurance company that the car was speeding and that they came out of no where. Also, take pictures of the damage to your car and the accident scene, to back up your argument and as evidence!

Depending on what the other driver says it will be easy to blame the accident on you, the law states you should wait until the road was clear before turning. Sorry.
