many thanks for all your answers, i must add that talking to my ex is not an option i have, due to the fact that on every occasion i have ever been on my own with this man? i have recieved beatings he is not able to talk as many adults can he has to resort to violence as he does with the children. my oldest boy aged 15 pack a bag to leave last week and was allowed to get to the door before being dragged upstairs and thrown around his bedroom the same son not too long ago recieved a head butt from his so called loving dad! if this man had any feeling for these kids he would go along with thier wishes especially the little girl who very much want to be with her mum, as long as he has his work he is happy! he is a money mad bullying coward who wont stand up to my oldest son who is far bigger than him and has two little girls of his own he takes time off from work to go and watch a school play or if either girls are ill which is what parenting is all about xxx

it all depends on the court orders in the custody. you should be taking notes and writing every thing down and have your kids make statements in writing with dates and times he's done this you should take him to court and also call the police which sometimes doesnt help so going to a lawyer is better than the police. if you can afford it there should be some legal aid in your area that will represent you for free. and most of times they only do it for abuse situations. Make an immediate application to the court for a Residence Order in your favour - if you are in the UK. Your ex will have to either agree or else convince the court that the children should stay with him. If he defends the application, a CAFCASS officer will interview the children separately from your husband and each other to find out what is really going on and what their wishes are. If your ex is abusing the children as you say, I think he has a good chance of having them taken away from him.

At the very least, I think you should contact Social Services and let them know that you have concerns, but I do also think you should see a solicitor as soon as possible about making a residence application.

All your kids have to do is talk in court and tell the Judge that abuse is going on in that house and they are out the door and into your house. He is an unfit father and that cannot continue. I would seek legal advice ASAP!!

in these circumstances of CHILD ABUSE you need to take this back to court and let a judge hear this from the kids. Then it is legal and there will be consequences for the ex

he should be in jail! kids over the age of 12 are considered old enough to make decisions in court. the safety of your kids is at risk, go through social work, hes endangering them. hope everything sorts out for you, if you want to talk some more, please e-mail me, i know how you are feeling x

Considering his behavior, I would think he might receive supervised visitation only. I would ask for exactly that! It's hard to go through this and my heart goes out to you and your kids.

Get the kids and take them to a womens refuge he will not be able to get to you or the kids and they will help you

kids over 12 have the right to say where they want to live. any judge worth his weight will give them top priority

In the Uk, the parent has not right to see the child, but the child has a right to see the parent.

Get legal advice.
