I need to use damask and retro frabrics on a range of cards and I want to check first if this is ok.

Yes, it is.

In the US, visual arts come under copyright.

In the UK, it's technically a design and not a copyright, which is another kind of intellectual property. So it would be infringement of design.

Some people will get pedantic and say it isn't technically copyright, but it's the same thing as far as it's all intellectual property.

Other countries have similar laws, and there are international conventions which most countries have signed.

If your card design is drawing directly on the fabrics - i.e. they are the main part of the design - then Yes, you probably would be infringing on either the copywrite or at least intelectual property rights.

If you took a picture of someone wearing that fabric as part of an outfit then probably not.

I'd ask permission first anyway - just to be on the safe side.

Probability could be your pocket can be sued if you used fabric designed in greeting card before you do this action check with designer guild and patent office if its protected by copy right laws

It looks like it depends on how much the design is used, and how or if the fabric designer copyrighted them. There's various court cases regarding this matter...

no. i don't think so unless it is copyrighted which would be somewhere on the fabric.
