My boyfirend asked me to marry him but we don't know if he is still married. He left his wife 10 years ago and has not been in contact with her since. The reason he left was that she was sleeping with her dying sister husband.

Very simple If you two want to marry get it done before the marriage officer/registrar where he has to produce the decree of divorce issued by the relevant court to show & prove he is actually a divorced person, without this documentary proof no marriage registrar any where in the world will solemnize or issue any certificate for marriage.

If he is divorced in Australia, he should have a Decree Nisci. Its just a peice of paper that is sent to you once it is all finalized, all certified and stamped by the magistrate. That is if he filed for divorce. If he didnt actually apply for divorce he may still be married even if he never had contact with her for years. So look into it.

Go to your states birth deaths and marriages. You may have to check the state that they got married in and the state where his ex would have got her divorce. They will be able to tell you. He may need to show a marriage cert to prove who he is but they will tell all that.
