I ordered satellite service from a major satellite company. The installer arrived along with two of his friends that came along to help him as I found out after the fact. One of the men was hurt when my deck collapsed with two of them on it. I called for an ambulance and when they arrived the man refused treatment saying he was ok and walked around for a while. Now I am being asked to pay for very high medical treatment and I need to know if I am liable for the injury or should the installer be responsible or the satellite company the installer worked for?I ordered satellite and now it is going to cost me a fortune for having done so. Any knowledge on this matter would be greatly appreciated.

You may want to call and speak to someone at the satellite company and explain the situation. But, for worst case scenario, you may want to contact your home owner's insurance company. You should have some kind of coverage for a disaster like you had and it will cover medical expenses of others injured on your property. Even if they had been workers for that company, they could have gotten workman's comp and then also sued you in a civil court (pain and suffering, expenses not covered by workman's comp, time loss from work) for the faulty deck.

I would have to believe that the installer is required to carry some kind of insurance to pay for on the job injuries if these men were on the job at the time of their injury. I would suspect as long as you were not completely negligent in having them on an unsafe deck, the employer should cover their injuries.

His accident occurred on the job, so I would assume that it would be covered by worker's compensation. Who is asking you to pay for these medical bills? Most employers are required to carry a workers compensation policy, which should pay for all his medical bills.

I wouldn't pay a dime until I spoke with a licensed attorney or submitted the claim to my home owner's insurance company. As I don't know worker's comp. law, I can't tell you whether his on the job accident falls under an exclusion, or whether he was even covered by a policy. (I.E., was he an employee or an independent contractor.) Again, your best bet is to submit the claim under your HO policy.
