Are you still married to each other? If so, then he can take her anywhere he pleases as long as there isn't a court order against it. If you are divorced, then it would depend on the custody agreement as to what he is allowed to do concerning your daughter.

And next time give more information when asking a question. I'm tired of people like you who try to phrase a question to get the answer you're looking for instead of a truthful answer, and give barely any information so that some people will jump to the wrong conclusions.

If there is no proceeding on divorce or separation and it is NOT international travel, nobody would stop the parent. After all, would you need his permission to take your kid out of state to visit, say, your parents? If there is a proceeding, the other parent can report to the police or the court.

For a minor to go on international travel, the key is the passport. Both parents must be present or one parent notarized a document to show that both parents are consent to the passport application. With a valid passport, some airlines might ask for a letter but last time my 12 yr old traveled internationally with his grandma, the airline didn't ask for the mother consent.

Depends on whats written in the divorce. Standard rights are for the domicilary parent. The other is not allowed to cross state lines without written consent from you. Check your documents and if so, file a kidnapping report. Are you afraid for the child or just mad at Dad. When involving the law you must be careful on how and why you report the other parent. If he's a good parent with no ill intention; let it slide this time but express your concerns clearly.

If he is still your husband and there is no seperation then it's perfectly legal. However in most states if an order for divorce has been filed it usually includes a no interstate section unti the divorce is final. I went throught it myself. I had the trip planned a year in advance and my wife (soon to be ex wife) at the last minute said no and my airline tickets went to waste.

If you are still together then he could ahve just been going for a drive with your daughter if divorced and you have main custody it is illegal and can be considered abduction/kidnapping when ever you ask a question give as much info as possible to get the best responses. I hope she is back safe and sound God Bless.

you said your husband, so I'm a little confused on the question, if the two of you are still married there is nothing that can be done, unless that is not his daughter, not that is not legal. i would talk to the local police and see if anything can be done. but you know that is going to turn ugly so i would be prepared for the results.

I don't know what state you're in but, in Texas it is illegal. I had to either have the court's permission or my Ex's to take her out of state. Which was quite often because of my job. We had a very good divorce, if there is such a thing. But he was very agreeable so it wasn't a problem 99% of the time.

More background please.

If you two are happily married, he will be back, as will she. She is her father, so what's the problem?
It's not like he's going to live in that state without you, is it? So far, it's just a trip.

If you are divorced from him, and the court orders say not too, then he did wrong, yes illegal. If you are still married to him, why would he have done that? These are things for you to please consult with an attorney dealing with family law to ask. Take care.
