My previous employer told me that he sent out me and my husband's W-2 about two weeks ago we still have not received it. Our previous employer is now not answering our phone calls. I know that I can't call about not receiving a W-2 until after the 15 of Feb. but is there anything that I can do until then to encourage him to send me and my husband a W-2?

No there is not much you can do until the deadline of Feb 15th. Some employers drag it out for as long as possible,sometimes because the company has not filed -w2 info with the Social Security Administration (SSA). SSA provides for a later date to file forms- March 31. Since they probably have to coordinate with the IRS to help reduce fraud, the company delays mailing out the W-2s thus forcing people to call in to request a duplicate because the employee would be operating under the assumption that it was simply lost. It is not criminal, so there is no one to file a complaint with but just not very ethical.

The employer must mail and postmark the w-2's by jan 31st. If you did not receive it you must contact them for another one. they are not that difficult to produce (I sent out 120 of them).
If you cannot get in touch with them then call the IRS as they are the ones who establish and enforce the guidelines. An employer faces stiff fines and penalties for not adhering to the requirements.

If you cant get a hold of him how can you encourage him to send you a w-2. By law he has to give it to you before jan. 1st, so maybe you could ask your local law enforcement about legal actions.

he has up until the deadline date to get it postmarked, not much else you can do until then. some employers drag their feet and use every last day they can to get them out.
