My husband works at Wal-Mart part-time. He went to the doctors today and they told him that he had to be off of work until March 1. He took the note into work and the personel managers had left so he left the note in the office and went and told his department manager. She said that they would have to approve it or deny it and to check back in tomarrow. Can they deny it? I would think that if he had a doctor's note telling him to take off work, they couldn't dispute that and make him work. Would they have grounds to fire him if he refused to go back in until March 1?

He works in the cooler and he has been having trouble with the circulation in his hands. He found out it is a certain disease and he was put on medication.

If he has a legitamate doctor's note stating the duration for him to be out of work, his employer HAS to accept that. Wal Mart .... is a company all in its own, with their own rules and regulations. They are suppose to follow the guidelines of the Department of Labor, (Fair Labor Practices) but they insist on not doing so. You could have legal recourse if they insist on not granting his medical leave.

Provided it is not a bogus note they will most likely not deny it. Because of all the scam artists and forged notes they get they like to check things out before they approve or deny it. They will probably contact your husbands doctor just to ensure that it is on the level.Dishonest people make life troublesome for honest ones.

It would depend on what the note is for and if he really needs to leave becasue of a work/health related issue. Many employeers will try to give theire employies an easier job (like Light Duty) so that they do not have to pay sick benifits.
Your husband cannot assume that they will grant him the time off.
They will have grounds to fire him if he doesn't show up for work

no. It is illegal to work during the time you doctor said not too. I had some time off of work and felt good early. They wouldn't let me come back until my doctor's not had expired, or else their *** is on the line. And they can't fire him for that either. That is a stupid policy used to make people sweat and to discourage time off. Sounds like a control tactic and illegal if they deny it.

they may deny it, they may fire him for nor coming to work unti lMarch 1. It happened to my aunt. She kept missing work because she was having cancerous tumors removed from her breasts!!! They fired her for mossing too much work after denying her doctors note. She told someone who works at the unemployment office all about it while applying for unemployment. He then helped her by calling the right people who protect peoples rights in situations like these. She later got a call from a district manager representing Wal Mart customer affairs. She got her job back and is working now, and is able to miss as much work as she needs, as long as she is sick, of course. Stupid Wal Mart! I just read in the paper that one specific Wal Mart store was, for years, forcing people to clock out when their shift was up and go back to their work and finish their work before leaving...working off the clock. That store was taken to court and was forced to pay all those people for all those years of wages, like five years of time unpaid. Damn Wal Mart!

depends on the state. tennessee (home) is a right to work state. meaning that you can be terminated for any reason. not to say you cant take action. unemployment or labor board disputes or a lawsuit if you see necessary. but if he wants to keep his job he should persue it under the Family Medical Leave Act.

Who knows.....wal-mart is know for doing some really stpid thngs when it comes to their employees. If he has a Dr. note stating that he is not to return to work til 3-1, and they fire him, he could possibly have a good law suite.

Yes if you are in washington state its true. Labor laws are changing to accomodate the possibility of having foreign manufacturers set up factories in the US. So dont get sick for the countries sake since labor is one of the key factors in the decline in manufacturing here in the US.

They could. In Indiana, employment isn't as regulated as other places and employers face very little opposition when they fire someone-it's really difficult to prove discrimmination.
