It would be plagiarism if this person plans to turn the copied essay in for credit. I used to teach English. Anytime someone tries to represent work which is not their own as their own it is plagiarism. The mere copying of your essay is not plagairism in itself. It is how a person uses the copy that could make it plagiarism. Try looking the word up in the dictionary.

You own the copyright in anything you write that is your own work. If you allow someone to copy your work and present it as their own, they are guilty of plagiarism and any school or university would hold you equally resonsible as both of you are cheating.

If someone uses your work without your permission, not only are they guilty of plagiarism if they present it as their own work but breach of copyright as well.

Yes, but if you are you wondering do you get in trouble as well, well Yes in school probaly but there are some circumstances when you can aruge the fact that you never knew that they were stealing your work and you will be fine.
