I also have a son that lives with me, so shouldn't I claim head of household? I am not good at taxes and I want to make sure I know what to ask for before I take mine somewhere!

You can file separately or joint. If you file joint, make sure you do it through your divorce lawyer. A lot of people forget to bring this up during their divorce. And make sure you are together when it is cashed and you get half of it. Usually the person who is the main caretaker or has full custody of the child is the one who gets to decide, sometimes the courts have it in the divorce decree that you can every other year. Though many spouses do not pay their child support, so if they don't they have no rights to claiming them, but this has to be legalized. If you file separately yes, you can file as head of household.

If your divorced was final on or before December 31, you are single for the entire year. If your son is living with you, and you can claim him as a dependent, then you can file head of household.

Your marital status on Dec 31 determines your status for tax filinng. You are considered single for the entire year. You probably can file Head of Household since your son lives with you.

It is your marital status as of Dec 31. If divorced on that date you do NOT have an option to continue to file married; joint. It is single or possibly head of household.

Another poster brings up an issue. Your divorce decree may dictate who gets to claim your child as a dependent. I would double check that document and the rules covering dependents to be sure you can claim him.

As a CPA I would not recommend filing joint. If your divorce was final in 2006, then file single, if not file Maried filing separate. Filing joint tends to get sticky in divorce situations.

I stand corrected...it is the last day of the year. "look before you leap" comes to mind...sorry!!
