My husband and I have been together for 17 years, and all of my children are by him. But when I was preg, with our first child, we got in a fight ,and broke up, so I made my childs last name my last name..........years later were back together, and were married with three more kids. So now what do I do about changing his last name? He's the only one in our family (me husband and kids) with my maiden last name. How do I change it, without it becoming a fortune?

The reason im asking this question is because he asked. My husband is his real father, and his name is on the birth cert. So why does it have to be a big deal in the courts? My son is 13, and this is something he wants to do as well as his father and I.

You don't change his name. You ASK HIM if he wants to change his name. If he does, you can usually go down to the country clerk's office and do that for only a small fee.

Depending on the age of the child, it may be as easy as just notifying the school and filling out a replacement social security card. When I was in school I knew several people whose parents remarried and they took their new father's last name. Since in this case the biological father is also the adoptive father, there's not really any room for anyone to complain. However, if they're old enough to have a driver's license or state ID card, then it may be a little more difficult. Still, the most it should be is some tedious paperwork, there should be no need to get a court involved or anything.

In all honesty, if he's a teenager by now let changing his last name be his decision. I'm sure that if you explained the situation to him maybe he'll have a better understanding as to why his last name is different from everyone else's and if he feels left out and wants to change it, then by all means find out how, but let it be a decision he makes for himself because of school and different adolescent issues he may not want to make drastic change like that because of the response he'll get from his peers.

I don't see it as a big deal, hopefully your husband and children won't either. It also might have been wiser to do something like this right after you and your husband got married.

The only way to do it, it's to go to court and do it, but you can start using it informally. You can call his school and tell them you are now using this last name, until you can get it done legally, I worked at a school and we had student who did that, and no one gave them a hard time, it's not a real name change and not its not legally. My uncle and cousin have done that with their first names, they didn't like them so they just started writing the names they liked instead of their given names. For my uncle it had been so long since he used his birthname that once we got a letter with his birth name on it, and we had no idea who it was.

A legal name change is not expensive. You can pick up the form at the local courthouse, fill it out, pay the small filing fee, attend the hearing and get the order signed without the assistance of an attorney.

If you get confused, contact a local document preparer. They can help you with the paperwork.

I don't think that there is a way you can change the last name without paying some $$. Either change the name through the usual legal ways, or perhaps have your husband "adopt" your son (don't know how much it would cost, or if he even could)

I don't think that it should be that expensive. Go to your local court house and ask what the procedure is. A legal name change should not be that complicated.

In most states a name change is not hughly expensive. You can contact your local court house or go to your local libary to go online to see if they have pro se (do it yourself) papers for name changes. It is not usually a complicated matter, especially in such circumstances as yours. Good luck and God Bless.

Well it's cheaper if the father agrees to it. Here in PA it's 500 if dad don't agree. If the father agrees then I think it's only 100 dollars. You have to go see a judge.

How old is the child. Why don't you ask the child with your hubby present but wait till the child is at least 14.
