You know, I found the answer to this question in less than five seconds by typing *texas statutory rape* into that little "search" box at the top of the screen.

He cannot be charged with statutory rape in Texas even though his gf is under the age of consent because he is less than three years older than her.

Yes they can. Even though she's 16 and consent to casual sex, it's the fact that he's of age, and should know better. He's the adult.

Now that there's a baby in the mix the "ADULT" thing to do would be to sit down and talk with the patents. Tell them his intentions. Like does he plan to stay in the relationship and help raise the baby? Parents will want to know if he's going to be there for their little girl or not. It also might be a good way to put some leverage down for them NOT to press charges on him.

What is the law in Texas? I know in Ohio (where i live) there is a 2 year age difference allowed. In Indiana, 16 is legal for any age. Find out what the law is, and tell him.

Im not sure about texas but in my state the age of consent is 16 so that rule does not apply

my cousin was 17 when she had her son with her bf who was 19. They didnt press charges because the BF went to talk to her parents about the situation and told them they are going to be responsible. I say show the parents your a real man by taking a stand to talk to the family about what's going on, and dont be afraid to show that it will be hard, but you will try.
Whatever happens, dont get married. It will be hard enough to raise a baby, but try doing it while working out a marriage. Get used to the flow of the baby and parenting.

Yes, they could press charges if they wanted to. They probably won't, though, unless you've had a really bad relationship with them from the get-go.

If she is under the age of 18, she is considered a minor. Therefore, he may be charged with rape.

It may vary from state to state. In most states you are allowed a two year difference. I believe Texas is one of those states. so no they can't.

Yes they can. All you can do is tell your friend to go to her parents and be open and honest. Tell him that there's no running from it and he might want to start showing her parents that his intentions are to be a good father and he never intended to harm their daughter.
Maybe he'll be lucky and they won't press charges on him.
