If earth was invaded by creatures from another planet would it be legal to kill them provided that they dont kill us first with their ray guns?

I just dont want to get hit with some rules of engagement b.s. should the day come that we need to fight off the invaders from space.
for some strange reason its against the law to kill invaders from another country, just want to make sure its ok to kill aliens from space should i need to

I think this question, if asked sincerely, is quite thought provoking. What legal rights would an alien have if they arrived here? You would have to assume they wouldn't have an embassy to represent them. However, the same could be said for your dog and you would go to jail if convicted of killing it. What if your alien isn't carbon based? I've killed several silicon based computers (premeditated) without going to jail. Unless your alien is recognized by a legal court as having basic rights I cannot see how you could be convicted of murdering it.

It's all about semantics. Supposedly, imprisonment without being charged for more than 24 hours or so (exact time?) and torture are both illegal in the US, yet the US Govt has practiced both at the US base of Guantanamo.

Yes, it's legal, just like it's legal to kill invisible elves in your backyard when they cause mischief.
If you ever get invaded, you have my permission to shoot them.

There may very well be martian microbes (bacteria) on Mars, and while there is no specific law that prevents them from being killed, we do take every precaution to preserve them for discovery and study.
If they were to be brought back to Earth someday, and caused an infection, then they would be killed

dont worry no law says you cant kill martians,just make sure you dont just wound them and they come and get you.
