We had a snow storm last night. MY mother in law was on her way home, after sitting in traffic for five hours she decided to come to our house. She has a min pin she takes with her every where. She couldnt get home we were declared a level two snow emergency. This morning we were issued a eviction notice, because she had her dog with her. Our lease does say no tenent shall keep a pet. Is this a wrongful eviction. We have lived here one year with no prior problem from management.

The answer to your question is, yes, your landlord is being an a**hole. No you can not be evicted because your mom came to visit and brought her dog. Either a neighbor or the landlord heard or saw the dog and assumed it was yours. Most likely if you explain the situation he will relent, if not call and explain the situation to legal aid, the local T.V. stations, radio stations and newspaper, he'll be forced to drop eviction.

Yeah, did you actually explain to the management what the deal was? Eviction notices often have some sort of court process attached so simply explain the situation.

The lease says no tenant will KEEP a pet; does it say anything about pets visiting for a few hours?

I find it VERY difficult to believe that you were evicted after 12 hours of having a dog in your apartment with no prior issues.

i think it is wrong..if you told your landlord the situation he should understand ....if he doesnt then he is an *******
