I worked with them for 1 year and never received overtime even though I was a contract labor pay according to tx laws I am due overtime pay but no one seems to have an answer..

Contact the Texas State Dept of Labor to file a complaint against the employer. They should be able to help you.

depends on how overtime is done there. If it is day by day, then anything over a full time day you are entitled to. If it is hours in a work week, it does not matter if yiou were working 12 hour days aslon as you were below what they consider full time hours for the week. You need to prove that you actually eorked these hours. A calendar that you filled your hours in or a copy of the schedules are good enough. You will also need to find your pay stubs to show that there was no overtime recieved.

You usually have 6 months to file a complaint. Dont give up. keep on fighting with them. They will most likly send you a form to take to your former employer and give them a chance to respond with about 2 weeks. If not then you contact (its called Employment Standards here) them back and move on oth your complaint. They will investigate. Sometimes they will order the employer to pay you but it usually takes alot of phone tag and persistance.

CAN YOU PROVE YOU WORK FOR THEM, CAN YOU PROVE THAT YOU WORKED MORE HOURS THEN THE BASIC HOURS YOU ARE TO WORK? If you have this proof, contact the state labor department. Things will go from there, all your questions will be answered.
