killing an animal is not the same as killing a hman but, this is changig. Some guy went to prison for a long time for killing an animal but I don't know the circumstances. Is your case believable. Well, that depends of how good your lawyer is and the judges interest in the case. You can make anybody look guilty or inocent with a good argument. The only way to prove if the argument is real or not is if there is evidense. So in your case they will have toprove that you had some sort of malicious intent to kill the cat. Have you threaten to kill the cat before? What is your brhaviour around the cat?
Also, in the end is what the law says not what is right or wrong.

Yeah, the cat should not have been in the office.
Check with your compliance officer to see what the company policy is with respect to animals in the workplace.
Unless it is a seeing eye cat, The court will be in favor of you.

Why did he have the cat in the office? He better be glad OSHA or the Health Department didn't come in. Of course your story will stand in court.

As well as getting the court will probably fine you for gross animal abuse. I hope that you get a cat loving judge..Three shots, who do you think you are kidding. Good thing you don't carry a gun....

Plead self defense in court. saay that you thought the cat was about to attack you and you only fired the nail gun to protect yourself.

Why were you using a nail gun to put posters up?
I'd say you're guilty.
