When I run splinter cell double agent it will crash sometime during its startup and spew forward a string of error messages relating to the pixel shader. My graphics card is a radeon 9600 pro and I think it has a 2.00 pixel shader is this high enough and if not how can I upgrade it ?

i would try to get the latest video drivers from the manufacturer of the video card first. also make sure you have the latest version of direct x. if you're still having problems, your video card's hardware might not be compatible with the game and you'd have to get a new video card. check the game's requirements to make sure you'll get the right card if you do have to replace it.
