Your tax filing status for the year is determined by your status on the last day of the year, 12/31/XX. Even if you file single all the days of the year, if you get married on 12/31/XX, you are considered "married" for the year 20XX by the IRS. However, I would suggest you talk with a tax accountant or lawyer to make sure this is the best way for you to file. There are several ways to file as married, even married, but filing separately. I don't know your situation, so please check with a professional.

You file married, Do the math two ways , Married filing Jointly and married filing separately. Whichever nets the two of you the largest return is the way to go. I got married at the end of December 2004. Should be a nice return for you guys this year. Congrats

Your filing status is determined by your status on December 31 of the tax year. If you got married in September, you file married or married filing apart.

Since you're married at the end of the year, then you file married.
You have the choice of filing separately or jointly. The latter should be best. However one files, the other needs to file the same.

2 options---Married filing jointly (you will get more back this way)---or Married filing separately, but you must prove that you lived separately for more than 6 months of the year--
