my friend ended a bad relation ship in which his fiance paid for the appliances with her grannys card and she says she is taking them with her when she moves out can she do this or does he need to take legal action and make her leave them

she hasnot worked since they have been together and she is lazy she didnt do any housework or anything
i told him that he needs to discuss who gets the appliances with her grandmother since her credit card was used to pay for them

It depends, its never as clear cut as 'if she paid for them then they are hers' as whilst she was paying for these items was her ex fiance paying for other things which she was also benefiting from? (i.e car, household bills, telephone etc etc) - its the same principles as a marriage - although (for example) the 'husband' may be working and, as he is earning all the money that doesn't mean that the 'wife' isn't entitled to her share of THEIR possessions just because she didn't physically pay for anything, she contributed in her own way by (i.e.) keeping house, cooking, cleaning etc etc and the courts recognise this.

However, look at this seriously, do you honestly want to make things anymore harder by worrying about a load of household appliances - you can get more - why fight over it????

Besides, the expense of taking it to court or even paying a solicitor to write a few letters would cost MORE then all the appliances put together!! Tell your friend to save their money and buy new appliances.

Legal action only costs money and drags things on. He would be smarter just to write it off and be lucky he didn't marry her. I'm sure there must have been problems on both side so just let him learn from his mistakes. However, if they live in Canada and have lived together over 3 years then they are regarded as spouses and if he feels he contributed money, etc to this arrangement on a 50/50 basis or more then he could sue and try and recoup some of his losses.

Absolutely! Before you do anyting drastic go to her new place and demand it back. Remind her that you loaned it to her and that you want it back. IF that doesn't work threaten to call the police, when you do call the police show them that you have all the paperwork that proves it is yours. Also presenting a credit card bill or bank statement with the charge on it will help your case. good luck

"She" paid they're HERS..... if he tries to fight and she has the recipts he's gonna loose

I bought a house my now Ex took me to couert over some stuff she paid for but had NO recipts..... the Judge kept asking her for them I WON!! One of them will have proof of who paid for them, and that person will win.

He is best off by saving the money to replace them once she is gone. They are hers.
