Good question. She should have been arrested for attempting to sing. While you're at it, see to it that all of the American Idol contestants get arrested for exposing my ears to an unrecoverable pain. If we started arresting everyone who didn't wear underwear, NYC/Hollywood would be a very lonely place.

This question has been answered here before. Please check the archives next time.

Not wearing underwear isn't against the law. Spears was wearing adequate clothing. It's just that when she turned a certain way her crotch was visible for a brief second. The only reason we know she wasn't wearing underwear is because there were numerous photographers shooting multiple frames. Otherwise, no one would have noticed much, if anything.

Also, for person to commit a crime, she must have intent to commit a crime. Your question suggests that if a woman's pants were to rip in public and she weren't wearing underwear she could be charged. That would be ridiculous.

In addition, in most jurisdictions indecent exposure requires the display of the genitalia and for that display to be intended to alarm others. A female's genitalia is internal, not external. There was a court case in Maine a few years ago in which the police cited two college women for indecent exposure after they streaked through a downtown area. The girls were ready to plead guilty, but the judge hinted that they might want to reconsider, in light of the law. The girls did and asked but one simple question of the officer: Did you see our genitalia?

The answer was no and the verdict was innocent.

Please remember we are all nude under our clothes and actually nudity inself is no perversion as the Puritan ethic will have you believe. The human form -well some of them- is beautiful and has nothing "indecent" about it.
