Sure, blame Marlboro for something YOU decided to do. It's unfortunate that you have cancer, but I don't think Marlboro shoved them in your mouth or twisted your arm. Take responsibility for what you've done.

There are individuals right now winning suits against big tobacco companies but the Powers That Be (Conservatives Elected Officials and Conservative Judges) are not in favor of these judgments and are doing everything in their power to have them dismissed. Sorry. That's the facts of life. (The old Marlboro Man died of cancer, too, as did many famous people of the 50s and 60s, when cigarettes supposedly did not cause any harm and it was "cool" and "suave" to smoke!)
It was not so long ago when some former employees came forth to denounce the tobacco companies for adding chemicals to make the tobacco more addictive, and just last month it was disclosed that the tobaccos in the cigarettes today are even MORE addictive... and it is not incidental... but a deliberate and calculated scheme by the tobacco companies to keep smokers hooked to cigarettes!
They used pyschological tricks in their ads to seduce you, me... EVERYONE, including minors and people in Thrid World countries where they export their cancer sticks! It's big business; be assured that the Conservatives are going to try to defend them by shifting ALL of the blame to you (but what about the psychological effect of their ads in buses, TV, stadiums, walls, trains, diners, etc?)
Yes, you probably can join some class action suit presently underway; call the State Bar Association in the State you live in and start making inquiries. I encourage you to do all you can, if not for yourself, for those you will leave behind! Go after them with a vengeance!
The sorry state of affairs is that you and each and every person suing will EACH give the attorneys 1/3 of what you sue for and the attorneys will make FAR more than the people suing, and then they will rip you off further by adding "incidentals" like extra hours, paperwork they will allege they performed, interviews performed... really nonsense to hike up their fees... when it should ALL be included in the 1/3 they get for representing you.
I was going to come out with a joke but after 43 years of smoking (even when I was actively involved in athletics), I have no idea what conditions my lungs are in. I stopped in January of 2005 cold-turkey (yes, after 43 years) and I have not had that dry morning cough and can finally take a deep breath!
What the heck, here's the joke that really happened to me many years ago when I was fresh out of high school: I do wish I could sue a particular beer company! I once got drunk drinking that beer and woke up the next day with the ugliest broad I'd ever seen in my life! I grabbed my pants and put them on when I stopped running at the train station... people were staring at me! I want to sue for waking up next to such an ugly broad and the shock and embarrassment I suffered!

So in 40 years, you failed to read warning written on each pack of cigarettes? Now you want to sue Marlboro.
By the way, what made you think cigarettes won't give you lung cancer?
Please go ahead and sue Marlboro ... don't worry people will be suing you too for making them passive smoker for 40 years.

You can file a lawsuit for anything, but as the case where people sue fast food places for "making" them fat, there are now bills in place that aim at establishing responsibility for the person controlling their habit, so you would most like waste your money.
Honestly though, did you think the label on the side that says "lung cancer, emphysema, and birth defects" were the ingredients or something? 40 years is a long time not to notice that, and its on every single pack.
By the way, I would imagine would also have to PROVE that it was directly the cause of the smokes that caused you to get cancer, I'm not to sure about wither cancer risk can be inherited or not, but hopefully you were never exposed to any exhaust fumes, asbestos, or other harmful substances.

Actually, the government already reached a settlement with Big Tobacco. In lieu of individuals being able to sue (outside of a few extreme cases), tobacco companies have agreed to drop marketing towards kids, sponsor quitting programs, fund those programs, and advertise those programs.
So instead of you getting a cash settlement, you get a commercial telling you to knock it off.
By the way, it was 4 liberal senators that drafted that lawsuit against the Tobacco Companies, not "rich Republicans".

They've really cut down on those lawsuits. The states got their money for "healthcare" but smoking was you're choice, so take responsibility. You've known for years that it can cause cancer. And I am a smoker. Newports, pack a day

When Marlboro placed that warning label on cigarette packs, they were basically covering their backs, for they knew you would be pondering this lawsuit, eventually.
