My husband and I have been separated for 18 months. In 6 more months (according to the state that I reside in) I can file for a complete divorce. I drive by the place he resided at about once per month since I moved out. When I drove by in December he was still living there (car parked outside furniture on patio, drapes in windows etc.) Now since January I have been driving by and now there aren’t any drapes, patio furniture or his car there. In fact I can see straight inside from the parking lot and the place is totally empty. I can’t serve him papers unless I find him … I don’t know where he works and we have no mutual friends. What do I do? Even if I could find his phone # (I doubt he has one) he wouldn’t tell me his address anyway so that I can serve him with papers! I don’t want to get a lawyer involved b/c I don’t have that kind of money.

Every state has a procedure to follow to give notice to a person even if the person cannot be found. Sometimes it is posting the document in the courthouse, sometimes posting something in the local paper. You simply need to get the forms to fill out from the courthouse or legal aid or an attorney. Not being able to find the person shouldn't hold up the proceedings for more than 30 days or so during the notice period.
Good luck.

You should have some type of free legal aid clinic in your state...ask the court clerk...they will tell you who you need to talk to. See if you can post a public announcement...like in the newspaper...and if he doesnt respond in a certain amount of time they consider that as him getting notice of some kind I believe. It should be fairly simple since you dont have kids or a house.... a paralegal could help you with the paperwork..and probably also give you info. on how to get it finalized in this situation.
Good luck!!

You need to divorce him on the grounds of abandonment. Try legal aide and see if they can help you with this one. He has moved and disappeared so you cannot find him hon. Trust me he is not wanting to be found.

Yes.. send papers to the last known address.. stop driving by his house or he could get a restraining order on you.

I had the same problem. What they do is post it in the local newspaper that you have filed for divorced for a period of 30 days.If there is no responce from him in that time period they will proceed without him.Just because you can't find someone doesn't mean you can't divorce them.
