I'm not sure about your state's laws, but I think the general rule is that a stepmom's income is untouchable since the kids are not hers and she's not responsible for them.

Well, they will take her tax return if she files joint and if he is behind. The ex can not go after her wages they can only garnish his wages. IF the ex is a bitty beware she will hit him up for everything. For example, in some states not sure about yours, she can get apart of his retirement, he might have to have insurance covered on the child, every 3 years she can have a wage review and if he has had a raise in his wags the support will go up.. The best ting for her to do is call the Child Support Enforcement an ask. I wouldn't mention any names. Just state what are the cons of marring a man that pays support and how will it affect me and our finances. Believe me I have been through this my husband had to pay support for 2 children from 2 diff. moms. and I now receive support.. Make sure they keep copies of all pay stubs to have proof it was paid.

Also have her contact a lawyer for advice.. And a taxpayer.... REALLY. She needs to protect herself. Just to make sure.... I don't know if it's possible in all states but I do know yes it is definately possible. Your family member needs to check into that. If the other woman knows she can do this believe me, I'm sure she will try. If the father isn't paying child support and she knows she can get it from the new wife she will more than likely try.

No, the amount is based of the parents income not the spouses.
HOWEVER if he owes back child support and they file their taxes and are due a refund the IRS will take the refund to pay the back child support. There are some ways around it (to an extent and yes they are legal) if it comes to that.

NO WAY they can not go after her wages for his child support. She may want to file taxes under married filing separatly, and keep separate checking and savings accounts but other than that...nope

in most states once they are married they will ask him for his household income which does include the income of his new wife. if he uses a lawyer though they can usually only go after his wages

NO THAT IS NOT POSSIBLE. I AM REMARRYED. AND YOUR NEW SPOUSES INCOME HAS NOTHING TO DO WITH THE CHILDERN. WHEN MY EX AND I REVIEW THE CHILD SUPPORT MY NEW SPOUSES INCOME IS NOT EVEN AN ISSUE. THE SUPPORT FOR THE CHILD IS ON THE MOTHER AND FATHER, NOT ON THE STEP PARENTS. HAVE HIM ASK HIS LAWYER.LAWS ARE DIFFERENT STATE TO STATE
