my husband divorce me and wrote me a letter promise me that if i sign the divorce paper, he will return $1700 loan for me and transfer the title of the vechicle to my name after i signed the divorce paper.

After I signed it, and the divorce is final, then i can never reach him anymore, and the settlement of divorce didn't cover this loan, so do i have enough prove and evidence to prove that it's a loan? will i have good chance to win?

Yes, you can sue your ex. It happens all the time. Since you have a letter promising payment, it will be up to him to prove he has paid for it.

Some things to remember in court:

It is not Judge Judy, don't let your emotions in
He might not show, if he doesn't if you prove your case you win
He will have a judgment against him; however, getting him to pay it might prove difficult.
If this was handled in your divorce decree (part of the divorce agreement) then you have to go back to the court that issued the order.

Write down all the things that make her special - Anybody can spout things off without any thought, but the romantic gentleman will take some time. Writing down several things that make her special is one way to show her that she is worth thinking about. Obviously you have to give her the list. It's okay if you are nervous. Even if she appears upset when she takes the list, what counts is that she takes it. It's virtually guaranteed that she will read it at some point - and then re-read it. You have just given her tangible evidence that you may be worth being with.

Buy her a dog - Be sure she can handle a pet first. The dog will be able to show her affection when you are not around. Each time it does, you will gain a few extra points. If you are concerned that it's not nice to use animals in this way, then rescue one from a shelter. You could be saving a pet's life and making someone happy at the same time. Plus, it shows you are a caring person.

Pray - For those who believe in a higher power, prayer can really help. Often when going through a break up, the bitterness makes it easy to forget that everything can be prayed about. By the same token, you can talk to someone at your place of worship. They will often have good advice and help you get the right direction.

Go on a picnic together - It's romantic, and gives you a nice setting to discuss things in a peaceful manner. You choose the food and location, above an beyond that, let her set the topics of discussion. Remember, you can always go on another picnic.

You can try, but chances are high that the final judgement will superceed anything else that was signed BEFORE the date of your divorce. I foolishly signed an agreement with my ex & I got screwed out of everything! Even my final judgement was worded in a way that was a sham & now that (his) Lawyer has become a Judge, no one will touch my case! Lessons learned usually come a day late & a dollar short! I'd definately give it a try if I were you. You may never see the cash, but you could have a judgement entered & ruin his credit rating! That's a bit of payback that just may be worth the cost of the filing fee! If the final decree did not say who gets the car, then why not take your letter to the Dept of Motor Vehicles & have the Title transferred into your name, then repo the car. Once it is in your name, there is nothing he can do, except sue you in return! If you just want his address, then perhaps it is on record with the vehicle ID & plate number. See if you can get a printout with your letter from him to you at you local DMV Office. If not, then send his court papers to his last known address, via certified mail, & you will have proof if it is undeliverable, not picked up, or forwarded to a new address.

Did he sign this letter, and was there a witness, that also signed?
If not, then you might be out of luck. If all the signatures are there, then it's a binding contract. But I'm not a lawyer, you should see one about this. Even just a quick, free consultation, to see if you have a real chance.

Yes, the letter he wrote to you serves as a binding contract. You should retain an attorney and get this settled. You can also sue your husband for the cost of your attorney and the court costs involved in this case.

You never know unless you file. The good news is that small claims court is cheap and doesn't require an attorney. Go for it, and let the courts figure it out.
