Age has nothing to do with it. Rape is unlawful sexual activity and usually sexual intercourse carried out forcibly or under threat of injury against the will.
If you are referring to statutory rape(sexual intercourse with a person who is below the statutory age of consent) it varies from state to state.

i assume you are talking about statutory rape. It varies from states. some states the age of consent is 16 and some states it is 18.
