i'm 7 months pregnant and my medicaid was recently cancelled because dhs requested more information at the last minute and didn't get an extension. then i got a bill for my ultrasound and a visit to the emergency room that should have been covered the reason for not being covered was because dhs failed to put my physicians name on my file. when i went to reapply, i took in the extra stuff they needed so they would have all my information. my boyfriend's ex girlfriend works as a receptionist there and told me i'd need to bring his social security number and a copy of his birth certificate in which i wondered about. now it seems that the copies of his check stubs have wound up at the child support office and she's trying to get his amount raised. if i'm not mistaken, when the papers are for dhs, they are confidential and for my file. isn't it a crime to remove a private document from a place like that. much less to try to use it for your own personal gain? what can i do about it?

It most certainly is a crime. She abused her position and if I were you I would contact her supervisor and a lawyer.

If this girl works for dhs in your area it may not be a crime because sometimes people with over do child support are red flagged in most Government Departments through-out the U.S. and they have a right under Child Services to in form any and all agentsey of the where-abouts of that person. But It dose sound like you may have a legal claim against dhs for failure of a client and your unborn child. Seek out legal information through your clerk of courts or a lawyer. I went through something like this because I had some back do payment of child support and a social service department turned my name over to a child support agentsey.Sorry but I don't think you can go after this person for any crime that you might think they have done.

Do you have an individual case worker? If he/she seems like a person who would help you, you might start there.
If not, I would contact the state office of DHS. It is probably located in your state capitol.
You might want to check with a lawyer about this if you can find one who does free consultations, to see if you might have a case against the person or the county if you want to pursue it.
If she did this, she is being unethical at the least. You may not get this resolved if you simply go to her local superior and complain. You could try that first, but if you do, it would give the ex a chance to rebut your story and people that work together may stick together against you. Whatever you do, good luck.

Contact the office manager of where that receptionist works and explain what happened.

YES, it is a crime. It is a violation of the national HIPAA laws that are supposed to protect against this very thing.

If this woman did this- she is in violation of a number of different regulations/laws.

not that you can aford it if your on medicaid but you need to consult a lawyer. She should not have removed items from your file, made copies, ect. Gald to see your boyfriend has more than one kid. One with the x-girlfriend, one on the way with you, how many more of his girlfriends and children are we going to be supporting paying for your medicaid bills and your childrens bills, bet you collect wellfare too.

Well... this is very much personal gain and I think that you should talk to someone who doesn't have a grudge and maybe talk to a "higher-up" about this

Yepp...it is definatly a crime!!! Totally illegal for her to do!! Contact a lawyer...and do it ASAP!!!
