Can u file for divorce if u admitt to adultery yourself? or does the 'cheated on' spouse need to raise the petition?

The 'wronged' partner needs to raise the petition and adultery cannot be used as grounds if it has happened over 6 months ago.

If you are in the UK, the respondent (ie. the adulterer) no longer has to name the co-respondent (ie. who they committed adultery with).

I don't think 'irreconcilable differences' is a ground in the UK. Unreasonable behaviour, adultery, seperation for 2 years or 5 years.

In unreasonable behaviour, one has to cite 5 examples of why behaviour has been seen as unreasonable.

There are fault and no-fault states. In a fault state, you can't get a divorce until you find fault with the other partner or yourself. Usually, in such states, there is a waiting period of 6 months to 2 years before the court will admit your marriage is broken. In those months, you and your spouse need to NOT share bed and board, meaning you can't ask the other person for rent, groceries, etc. Also, it means, if you are a woman, you can't get pregnant with your husband's baby in this waiting period as it generally indicates you shared bed, at least, if not board.
If you say you have been unfaithful, you don't get alimony, in most cases.

In no-fault states, you can just go to the court and say you want a divorce. If the other person doesn't contest it you are free in 2 weeks.

You can file for divorce because he has an ugly little toe. With the reason you gave at least he will come out on top so I must commend you on your honesty. Plus I think that you have some character. I mean, besides the cheating. That's just too weird. I usually stomp on cheaters without hesitation. I've never had one understand the need for divorce because THEY cheated. Tell me one thing, have you told him? Does he have a clue? Are you going to spill the beans so at least he has some closure?

Either one of you can file for divorce, if your spouse did not cheat you can file for divorce due to "irreconcilable differences". However, be prepared for you spouse to bring up your adultery if he knows about it. Anymore, the courts don't care if someone cheated or not unless there are children involved and even then it really doesn't matter unless it effect the kids in a negative way.

Anyone can file for divorce for what ever reason. Seriously consider your options, before you go through with it though. Your spouse is not always required to agree to the divorce. Be sure you want out, not just because you think your husband will.

Depends on your state. Iowa is a no fault-state. So, you don't have to have a reason to divorce. If you want a divorce, then file. If you cheated, then you can say that you don't love your spouse anymore, and that you want to be w/ the other person. That should be reason enough to file.

you could file for divorce and say you two are no longer compatable. I have heard of that idea once on tv. good luck . sometimes life just works out different than planned.

you can file for divorce at any time rather you did something wrong or not. (if your spouce just wants rid of you and agrees you can file for a no fault divorce and its cheaper than doing the whole fight over stuff bit)(if you have costody battles and marrital stuff to seperate it will cost more than a no-fault divorce)
