2 days ago, on Sunday night, while coming home, I witnessed a pretty disturbing car accident happen right in front of me. There was a Ford pickup in front of me, and as we approached an intersection (our light was green) another car ran their red light and T-boned the pickup sending it to the other end of the intersection. I called the police, and stayed to give a statement. My question is, how long until this case goes to court? (The family of the driver of the pickup is suing for a wrongful death)

It may take some time, considering that the family that is suing for wrongful death has to get an attorney and go through the process of filing a suit. It could takes months to over a year. And in some instances, it may not go to court (i.e. if the insurance company of the other party involved settles out of court).

I witnessed an accident and when I got home I typed up all I saw and heard. I put the paperwork in a folder and about 4 months later they called me to do a phone deposition. So I just pulled out the paper and read it to the lawyer. Then the next day the other lawyer asked me abou the accident and I read it again.
Write all the details down now and put in a place you can grab at a moments notice like a file folder or book. It could be months before they call you.

It could go on forever. That's the grand justice system we live in. If you are really geared towards helping the fords family I would keep your statement on hand so that when it comes down to testifying you will be prepared. Sorry you had to witness that accident you must be really upset. Also they might try to fight in the court of law and that could be a long process as well. So I would say you could be involved for a few years. Sorry dude.

Wow...the body is barely (if even) in the grave and they're already suing for wrongful death? Yes, the other car is obviously at fault, and the family should pursue action against them but damn, they should've allowed themselves time to grieve!

Anyway, no telling on when the court date is going to be. There's likely to be delays and whatever else. Seems nothing is ever fast once things get into the court system.

Depends on the lawyers. Some cases can be taken care of within 6 months, while others can be dragged out for years. If both parties agrees to settle quickly, then it can take no time.

It could take 6 months up to 2 years. really depends on the court systems.

it really depends on where the case will go to court. some cities can take months or even years for a civil case like that. i would say minimum of 3-6 months, but probably much longer.

it could take a while. and even once it doesn have a court date the process is not usually just one court date long, it can go on and on. the best thing to do is to check in with your contact monthy so you stay informed, but beyond that try to deal with what you saw and focus on other things. Sadly, it's not something that you will probably have resolution on very soon.

If someone was arrested and charged, then that (along with the court date) is public information. Call the police station or the courthouse to find out.

HI I AM EMT-BASIC IN MS. THESE THINGS COULD TAKE A LONG TIME IN GOING TO COURT. IT DEPENDS ON THE POLICE STATEMENTS AND HOW MUCH " LEG WORK" IS NEEDED TO PROVE THE CASE. SOMETIMES THESE CASES COULD TAKE MONTHS OR EVEN YEARS AND SOMETIMES THEY ARE SETTLED OUT OF COURT. SORRY THAT YOU SAW THE WRECK AND GOOD LUCK. HOPE I WAS SOME HELP
