I have a 10 week old daughter & the people below us smoke outside. We cant have our windows open because they are always smoking. Even when the windows are closed the smoke still manages to seep in. I've already talked to my manager & she says there is nothing she can do since thay are in their own home. I really don't want to move, but it seems like that is my only option.

Second hand smoke is a killer!! That's why I smoke, so I can get mine first hand.

Some options:

- Talk to the neighbors. Offer to pay them a monthly 'clean air' fee or something.
- Seal the offending window more. If it is letting in smoke, it is not energy efficent.
- Put a fan in the window blowing outwards. It will pull fresh air in from other, hopefully less smoky areas.
- Research the real risks of second-hand smoke and get some perspective on this. It is not as deadly as some would have you believe, although it still stinks!
- Buy the complex and make it smoke-free
- Negotiate with the owners to establish smoking and non-smoking areas of the building, taking into account vertical movement of smoke as well as side by side issues. This could be a good advertising bit for both smokers and non-smokers alike and might help increase renters! (Note- do this with the real owners, not the managers.)

There is nohing you can do about smoke that is outside. Inside is where legislation may have an impact, but, like the manager said, it's their residence, and they are legally allowed to smoke if they want. If it were your residence, then it might be different. Can you move within the complex?

Or you could always move.

It depends on your state and local laws. Try calling your local housing rights organization and go from there.
