Hi there -
I'm a server and the restaurant i work at is l.a. based and they just started this new policy that if an order was made and it was wrong for some reason, regardless if it was your mistake or the customer's, the server is responsible for paying the full cost of the dish. this seems so wrong and unfair! is this legal? to make servers pay for mistakes? any feedback would be greatly appreciated!

Not legal. I worked in a gas station and the owner tried to make us responsible for drive off's. Your employer has to get you to sign a paper saying that you agree to this policy. If he/she hasn't and you haven't, then he/she can not take any money from your check. It's stealing.

I do not believe that it is legal to charge an employee for a mistake or a customers order. I've never heard anything like this and I have worked in the hospitality industry for more 10 years.

I too don't know if its legal, but I doubt it. Humans make mistakes. I do know that it is legal to make servers pay for any shortages in the till. I agree...get another job.

I don't know about the legality of it, but I DO know that there are tons of other restaraunts out there to work in. I say quit. And if they are REALLY jerks I say quit during lunch rush hour.
