what is the law in the state of florida concerning charging customers diagnostic charges for out of warranty?

They are allowed to charge one hour shop flat labor rate then apply it to the balance of repairs if you have the repairs done at that shop. They're allowed to keep it if you do not have the repairs done at that shop. That's my basic understanding, and that's what most of the shops I'm familiar with charge and their procedure regarding diagnostic fees. If you knew what the problem was, then you wouldn't be there.
