Racism in an individual "is" potentially limited to that persons individual dealings and is still actionable in law under any of the anti-discriminatory regulations. So an individual who is deemed to have been treated in a prejudicial manner may have legal redress, if applicable.

Whereas, insitutional racism is often a (wide-spread) policy decision and may not give rise to any legal redress to a prejudcied individual since the law itself allows for that prejudicial act to exist and be propagate. e.g. in WW2, Jews living in Germany could not own property under the law during the Third Reich......this is a policy decision protected by law and no Jew could sue for redress....
