If you are married then the husbands name goes on the birth certificate(unless of course the husband doesn't happen to be the father for some reason) If not married and the father is present they will have him sign a paper stating paternity. It does not necessarily have to happen in the hospital either. And just because they have you sign no such paperwork does not mean you are not the father....they would have no way of knowing that.

Depends on the state. I know in California the father has to sign a letter of paternity. Either parent can sign the birth certificate. If the father is not present to sign the letter of paternity than his name cannot go on the birth certificate, that section will be left blank and on the mothers name will be listed.

It is not mandatory for the father to sign the birth certificate, but
if he wants his baby to have his last name. Then the certificate papers must be signed by him. If he doesn't. That wouldn't change anything. He is still the father.

I had my baby in the state of California, and my husband never signed any of the paper work and his name is on our son's birth certificate... Of course, there are a few factors that might contribute to this. My husband is in the Marines and was deployed in Iraq when our son was born and didn't come home until our son was 5 wks old and I had power of attorney of my husband, so for all legal reasons, I was him. Maybe that had something to do with it...

If you aren't married then it depends on the state. In OK the father can either sign the forms at the hospital or at a later date without having to undergo DNA testing. The only time DNA testing has to be done is if he contests that he is the dad

you and him decide if he is signing the birth certificate, and no it doesnt mean he's not the father it just means he has no rights to the baby.

Depends on where you are. In Canada we just write in who the dad is, or at least it was like that in Ontario when I gave birth last. My husband didn't sign anything.
