A colleague has a bit of a problem and I was just wondering where she stands on it.
Basically - she had booked 4 days off last week as holiday, but ended up taking the whole week off sick.
Her boss is now saying she still has to count those 4 days as holiday and not sick leave.
Is that right?

She self certified herself, the doc didn't sign her off.

Does this make a difference?

No - If she was sick and has a sicknote to prove this, the sicknote overwrites the holiday. Her Boss is breaking the law (certainly in the UK anyway....)

Self Cert is all that is required for the first 7 days - Take advice from CaB

Well, if she can prove that by having a doctor's note then she should be able to take it as a sick day. However, if her boss is already stated that she was on holiday she needs to seek someone in the human resource department or another manager to help her clarify her problem with someone who knows company policy. If her boss is the only one she may be back at square one.

You'll find that when you hired onto the company you probably signed a piece of paper that allows for random drug screening as well as screening if they have probable cause to believe you are using drugs. There is no law on this. It's an employer set rule as a condition of your employment. While you may think it sucks, they only way to get away from this is to find another job where drug screening doesn't happen. And those jobs are getting harder and harder to find.

She can claim her holiday (4 days) back as sick if only she has a proper doctors sick note covering the time she had off.
without the sick note she has to have it as holiday.

if she can get a note from the doctor that proves she was sick then no she does not have to take them as holiday, DOUBLE check your contract for all these things, if her boss is still kicking off about it go higher, and go to citizens advice!!!

A self-cert won't help as anybody could be on leave and then submit a self-cert to claim them back. With a Drs sick-note - she is entitled to claim them back. Citizens Advice will back this up.

If she has a doctor's note she can take them as sick days, if not she can self certificate herself and still take them as sick days, but would be better with conformation from doctor.

Her boss is right. EVERY employer has the same policy.

That's strictly a matter of company policy, but in my experience, that's usually correct. A doctor's excuse MAY help her, but it is still at the company's discretion.
