Well, your question's title and the question itself don't have too much in common, but I'll answer as I understood it.
Writing a fantasy story in an real or invented world [assuming you imagined that world] shouldn't be treated as copyright infringement. If you look through some fantasy themed books, you'll see that their surroundings are pretty much based on REAL history facts/cultures [like Rome, Greece, Egypt etc.]. But if your story is based on Eragon, you'll need Christopher Paolini's permission to publish it [in other words, only it that's the case here].

People have been writing fantasy on the ancient world all the way back to those times. However, in those times, people could not write since writing was invented later so they told tales which were handed down to us like Homer, for example or Beowulf.

You can write about anything but the important thing is the quality of the writing and why you do it. If someone writes a fantasy to fill in with a lot of porno then it is horrible regardless of how well the person can write.

Again, if someone writes a really stupid story about a hockey team or a dance group, it will still be a waste of time for the reader although the writer might learn from the experience or from feed back.

Am I right in thinking English is not your first language? I think what you're asking is if writing a story set in an ancient world would be considered copying off Paolini's "Eragon" and "Eldest"? The answer to this is, no, it would not be considered copying, because you're using historical information, not ideas from the books. If you take Paolini's ideas and try to sell them as your own, that would be considered plagarism, but just because you use a similar setting doesn't make it "copying."

Usually it's not a copyright infringement if you don't copy actual text word for word. However, if you just copy all the ideas in the book it can be. For example, after Harry Potter came out, a Russian author published a book about a heroine called "Tanya Grotter". Rowling sued and the Tanya Grotter book was pulled from the shelves in some countries.

Whatever your imagination can dream up is fair use.
DON BELIANIS OF GREECE
To Don Quixote of la Mancha;
In slashing, hewing, cleaving, word and deed,
I was the foremost knight of chivalry,
Stout, bold, expert, as e'er the world did see;
Thousands from the oppressor's wrong I freed;
Great were my feats, eternal fame their meed;
In love I proved my truth and loyalty;
The hugest giant was a dwarf for me;
Ever to knighthood's laws gave I good heed.
My mastery the Fickle Goddess owned,
And even Chance, submitting to control,
Grasped by the forelock, yielded to my will.
Yet--though above yon horned moon enthroned
My fortune seems to sit--great Quixote, still
Envy of thy achievements fills my soul.

Write on and slay the dragons of discontent.

I couldn't understand your question a bit.
If U're asking about copying rights, then take permission from the Author i.e. Christopher paolini.
