He is not on the lease....which is month to month. He has an alcohol problem and does not work.

You'll have to go to court and get a protective order, it's the only way you can get a spouse out of a leased apartment. Then once you've done this you'll have to live with the circumstances of a very angry spouse.

If he is not on the lease just tell him to get out. If a problem ensues, call the police and have him escorted out. You only have to go through legal channels if his name was on the lease.

Ok. You need prove that he is a drunk. Next argument call the police and with paper work you could evict him.

Give notice and move yourself out. Then he won't know where you live if he chooses to make problems for you.
