Consult a lawyer and insist that he pay for your council since you can prove he cheated on you and you are not causing this divorce. Good luck.

If you live in Calif., then tough luck, its a no fault state as far as divorce. It doesn't matter who filed first, for what, or under whatever circumstances, the court will split you two right down the middle.

I would try to find out what the laws are where you live and definately get an attorney. He/she will help you out immensely, especially if you have children and who should be the primary household.

I'm sorry for your loss/happiness (especially if you knew he was cheating on you.) I hope you can get over this with as little mess as possible.

Don't sign the papers and take him to court. It will make him look bad, and you woud be able to get almost anything you want that the both of you owned in the marriage. But there is no use fighting for the marriage if they don't want to be there.

you need to do some investigating to see if your in a state where adultery is held in court. not all states have this. then, if you are in one of these states, bring the evidence to your divorce attorney (you'll need one of these anyway). i hope for the best for you. you should also look into counseling to help you cope with the adultery, it's a horrible tragedy that happens to people, and you need to grieve about it.

That depends on the state you live in, if your in WI. there is a no fault divorce so it don't mean any thing. I would talk to a layer one that will give you free advice before taking on your case.

don't tell him that you have evidence... but make real sure you have it... wait for your day in court... then lay it all out... I've heard of the 'girlfriend' testifying... talk to a lawyer too... but if he cheated on you... and now wants a divorce... let him go... make sure you get your stuff though... I hate guys like that~!

If you bring up the adultry what are you wanting to come out of it.?

Are you wanting more money or your wanting to claim apart of the estate that the other person wants. ?

What do you want to come out of knowing what you know. ?

Get a lawyer and then sue him for maintenance(alimony) and child suport if you have kids...Then get on with your life..I am sorry for the pain he put you through..i have been through it all myself. I know it hurts,but you will cope and move on. Good Luck!!!
