he's been evicted, but we are miserable with him.

If he has to be out by the end of the month then I would say just bear with it and ride it out. If he's just irritating you spend more time in your room or at friend's houses. If he's violent or abusive call the cops. I'm assuming he got an eviction notice to be out by the end of Feb. but if he was supposed to be out by the end of Jan. then definitely talk to your landlord and/or the police.

If they've been evicted, call the Sheriff/Police and show them the documents and the roomate has to leave...

If you evicted them, with no legal documents, and are renting an apartment then you have to get your landlord involved with a "Roomate Removal" Form.

If neither of these two apply, then do what any person does to anyone they REALLY want out...pack up their stuff, put it on the lawn, and change the locks. Period.

File a trespass notice on him, and if he still doesn't go, then get the cops to take him away.
