Depends on the State in which one files for divorce. In many states, there is a no-fault divorce, by where one party can file and have the papers served to the other party. If there are children involved it complicates the situation, however it still is possible. Check with local laws and find out if there is a pro-bono attorney service. It would help to gain additional information before proceeding.
Also if the man won't sign, why not? Why is he holding out? If you find the answer to that, then you might be able to find a solution or a compromise.

Then it turns into a contested divorce. Eventually, you will be granted the divorce by the Judge, they just take a little longer than agreed upon divorces.

Talk to a lawyer, if you don't have one you will need one. when someone doesn't agree to the divorce its a contested divorce and you will have to go to court and tell a judge why you want the divorce and you will get it in time... my contested divorce took 2yrs! My ex stalled and dragged out the court dates as best he could to make my life difficult. But in the end a court gave me the divorce. So talk to you lawyer and file for dissolution of the marriage as soon as possible. Good luck and hope things go smother for you than they did for me.

where i live (mississippi), in order to get a divorce without signature, you have to suspect or have proof of adultery. my brother went tried to get a divorce for 2 years but she would never sign, finally he found out she cheated on him and that was the end of it. don't know about other states though.

u need to file for divorce-be separated for a year-have a witness who can vouch that you have not been together for a year-this means no sex with them-no living with them-no spending the nite together-nothing that could be taken as the two of you are trying to reconcile..i think after a year and as long as he has been served papers i dont think it matters if he will sign or not
