Jan 31 is federal law? Funny since the employer I am waiting on in the federal government!

Feb 1st I would have started calling.


I'm adding this in after seeing some things. I've called and reported when I haven't gotten it by Jan 31st, and I was told several time by the IRS that employers are not legally obligated to get it to you by that date. It's recommended, not required. My mom has had the same problem too. All the IRS has told us is "we'll look into it". And you never hear another thing of course.

So start calling the employer.

The law requires them to be mailed no later than the last day in Jan, so if you don't have it within a few days after that, you should be calling to complain.

you should be calling your employer or ex-employer right now, they are already late getting it to you. If a phone call does not resolve your situation, send them a registered letter so that if for some reason their delay causes you to file late you will have proof of their negligence and have back up for any legal actions that you may desire to pursue.

you should of got it by now. report it to the IRS.
