Micronation, the basics.?

Question

Lets say hypothetically I get an uninhabited island out in the middle of the pacific. If I buy it from a nation, do they still have legal precedence over it or is it effectively my own nation?
If it's theirs, can I succeed?
If I succeed, what kind of retaliation can I expect?

And finally, were I to successfully find an uncharted, unclaimed island and claimed it, starting my own nation, what should be my major priorities insofar as being a nation?

The United Nations generally frowns on new nations being created. That said, an existing nation, if it agrees to sell you an owned territorial island, is unlikely to give up sovreignty over that island. If they do, you might have a good start. Also, discovering a previously uncharted island may give you a good start. Note: building a structure in the open ocean will not work, as boats and structures are specifically excluded from being defined as "territory" (see point b below).

According to the Montevideo Convention (see link below), you have 4 criteria your micronation must meet to be considered a sovreign state:

a. permanent population
b. defined territory
c. government
d. capacity to enter into diplomatic relations with other countries

If you plan on living there permanently and self-governing, you have a and c covered. By definition, an island is a defined territory, so you've got b. Diplomatic capacity is another thing entirely, but I think we can establish that obtaining the territory in the first place is the hardest part.

Your priorities are:
1. Constitution - you need to establish your government, as required in point c above. A constitution can also establish the name of your micronation. Make it something long and complicated, but with a short nickname. For example, the full name of your micronation might be "The People's Democratic Commonwealth Republic of XXXXX and Holy Shrine of YYYYY". You could use XXXXX or YYYYY as the "short" name. Note that your chosen form of government does not have to match the name (see: People's Republic of China, which is not a republic).
2. Diplomatic recognition - so far, only Sealand (see below) has had any success at this, and they haven't had much. Without this, your passports, currency, and postage stamps (outlined below) won't do much good. It is unbecoming for the head of state to also be a diplomat, so you may need your family or friends to fill in there. Note that recognition by other countries is not a requirement of statehood under the Montevideo Convention.
3. Passport - you will be a citizen of this country, so you will need to identify yourself as such when you travel elsewhere. If you object to leather as a binding for personal reasons, use something metallic-looking. Don't use fake leather, as this makes it look cheap.
4. Postage and currency - not so crucial. You can deliver your mail yourself to your nearest neighbor and use their postage. You probably will be using their currency as well. If you plan on having a domestic economy, it can be based on barter. Currency gets you into a whole heap of trouble when your micronation gets its first counterfeiter. If you do create a currency, back it with a precious metal (gold, silver) or tie its value to a hard currency, like the US dollar.
5. Army - Naaaa.
6. Online gambling - by legalizing gambling, you can attract businesses to your micronation who would otherwise not be able to operate. Even a modest 1% tax on these companies could make you very wealthy. On the other hand, if the company flaunts its international independence too much, it may invite invasion of your micronation by a country where gambling is illegal, justified by their wanting to protect their own citizens from your country's predatory businesses. If you're okay with this risk, you may want to revisit #5.
7. UN recognition - the ultimate. This is how you know you've arrived. If you can manage to get on the non-permanent Security Council rotation, that's just gravy.
8. Economy - Depending on circumstances, you may be importing a lot more than you export. This will create a huge trade deficit. If you're independently wealthy (you are buying an island, after all), you're probably ok. But if you're looking for a sustainable economy, you will need an export. The sand and coconut markets are pretty much cornered. Tourism is a possibility. You can also legalize drugs and sell them locally. This would fall under tourism, since you would not want to export drugs. You may find the United States engineering a coup to overthrow you (again, see #5) in favor of a puppet government that they'll sell weapons of mass destruction to. Give it 20 more years, and they'll invade to overthrow that new government. You may have a chance to get back in at that point, but don't count on it. Look, just don't export the drugs, ok?
