My Husband get subpeona ,is there any way he can refuse the subpeona? i live in state of NH ..any help

I alrady have an attorney ..And he already fila for continuing the case my trail its going to be on march 8 2007( i suppose to go to trial on jan 11) its my Husband gona get another subpeona letter ? is he have to testify agints me ? a lot a poeple say in NH that he cant is it true ?

I don't think you can testify against your spouse.

He falls under a husband-wife confidentiaty law which is like the atty-client privledge. He could be subpeonaed as a hostile witness in this case which means he has to testify against his will but he can answer pleading the husband-wife privledge and nothing legally can happen to him. Good luck

Yes, if you are married, he won't have to testify against you. Talk to a lawyer. There are laws that say spouses don't have to testify against each other.

Unconstitutional! You cant be forced to testify against your own spouse! However, you can do so voluntarily.

yeah I just read a book that said its something called spousal privacy. Something like lawyer client privacy. or doctor patient...consult your own lawyer cause he shouldn't have to testify
