recently i found i was entitled to some housing benefit, as i was unaware of this until now i backdated my claim as my circumstances were exactly the same then as i am in now. My housing benefit was awarded but only from the date i sent my claim form in as my local council said even though i would have received help just saying "i never realised " is not acceptable. Would it be worth appealing as my council were quick to recall rent off me 3yrs ago when they realised i owed them from months before!!

just to add was from 9 months ago and i have payed full rent but was unaware i was entitled to some housing benefit even when i had my child and was on maternity leave 3 yrs ago i payed full rent!

hi...'yes' it is worthwhile challenging them...because 'if' you were entitled to it, and 'they' never informed you of this matter, then under the 'three' laws of...

'the local government act 1992/2000/2003'...
'the social security contributions and benefits act 1992'...
and 'the local government finance act 1988/1992'...

then 'they' must follow thes laws fully...so if they 'dont' and 'wont' uphold your appeal...then 'they' can be charged under...

'the theft act 1968/1978/1996'...

it 'is' a criminal act, and 'they' or 'someone' couls end up with a criminal record, and it is a jailable offence for 'them' to lie, mislead, or not inform you of your social rights.

Some time ago I sent housing benefit form in and got lost in the post. By the time my landlord got round to telling me and then having to send in another form, which can take a couple of months for them to process there was about 7 weeks that did not cover it. I wrote to them and asked that they consider my circumstances and a few weeks later they paid the difference.

if this is a genuine claim for backdating your housing benefit then you must know the reason yourself, you would not need examples. if you are just trying to get money out of the taxpayer then i hope they reject your claim

you don't specify how long you want it backdated - there is a 52 week rule, so they don't have to backdate anything beyond that. they are right as it's not their responsibility to contact you - they haven't got a crystal ball to check everyones entitlement.

You have to make an appeal in writing, which i suggest you do.

In the local authority where I work - unfortunately you probably wouldn't be successful but good luck anyway.

Always worth appealing against! Can you evidence why you didn't know you could claim? Is it because you have never been in this situation before? Have you been unwell? Think of as many reasons as you can.

You probably still won't get it though. Definitely worth a try though!

Benefits are only payable from the date of application , backdating does not take place.
It is upon the applicator to ensure that he is fully informed about all benefits and /or entitlements .
