You do not need a lawyer to file, but the forms are long and complicated. Get the bankruptcy petition forms from the court and see if you can fill them out yourself. If you cannot, make a copy and do the best you can. Then go to a bankruptcy atty for a one hour consultation to help you answer the portions of the petition you do not understand. It's very document-intensive and you are the person with all the information. There will simply be some areas that you may need explained, but with a little assistance, you can do it.

You can file bankruptcy without a lawyer but you need to be well researched and have plenty of time to do the work. The problem is that the new law has made it more complex and any mistakes can be expensive and cost you more than you would have spent on a lawyer.

But, here's a site that has some advice about doing it alone. Think hard before you go this route.

Easier to get committed in SC than bankruptcy with out an attorney.
