Do I have any right to see or hear/know what the ex-emplyer is saying to any prospective employer who asks for a reference about me.Could i maybe use the data protection act to find out what the ex-employer is saying about me?

I would just have a close friend call him up and ask for a reference as though the friend was going to hire you himself.

It would seem that you should request a copy from the person requesting the reference. Please see link below.

In a situation where there has been a dispute or the contract has ended on bad terms, a 'good' employer would normally refuse to give a reference. There is no legal obligation for them to give references and you could seek compensation if they have lied and you can show that this lie has prevented you from getting work.

If you have any doubts, I would talk to a solicitor to get some impartial advice. They will normally give you a brief consultation for free and if you are unemployed, you may be entitled to financial help. If you have been with a union, they may provide legal advice for a period after ending work.

I would contact the people who declined to employ you to ask them the reasons. They may not tell you but if you are reasonable they may be able to hint at the reason.

Actually I would not put them down as a reference only that you did work for them. You have the right to not let the potential employer call them if you do not want to.

Also your potential employer does not have to use the information given by your past employer. As far as human resources go you can not ask slandering type questions and if slander is given you are supposed to not pay attention(so to speak.) When I call other employers for reference I usually ask yes or no type questions only. (Yes I know not always the case for some.)

But no I would think that if you confront the person they could deny it and data can always be changed. Just walk away knowing you were a valued employee and they are just jealous.

Yes you can! I had this happen to me and I called the ex-employer and asked her for the reference. She sent it to me. Although employers are not allowed to give a bad reference, what they can do is not give a glowing reference. If your reference is "bad" you would have a good case and should seek legal advice. Your ex boss cannot give you a bad reference , he can refuse to give you a reference but if he is giving you a bad reference you should be able to do something get in touch with citizens advice they will help you.

easier to have a friend who has a business number to call and get the reference and ask for it in writing if possible I had a guy really bad mouth me after I quit when he is hospital he hated me for it. illegal but I had no money to sue him

No you cant, it is a private communication between two individuals you can ask about the contents of the letter but they do not have to inform you

yes, under the freedomof information act they have to produce whatever they wrote - i think they have up to a month to produce it after your request
